ELUXURY'S DREAM VACATION GIVEAWAY

Eligibility: eLuxury's Dream Vacation Giveaway (“Competition”) is open to legal residents of anyone of the United States who are over the age of majority in their country, province or state of residence. Employees of Sponsors, its divisions, affiliates, subsidiaries or advertising agencies associated with this Competition, and relatives of and those living in the same household as such individuals are prohibited from entering. For the purpose of this Competition, relatives are defined as spouse, partner, parent, legal guardian, in-law, grandparent, sibling, children and grandchildren. Void where prohibited by law.

Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of eLuxury, as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws.

During the entire competition, there is a threshold that must be met at the end (May 11, 2016). If not hit we must cancel the giveaway.

Sweepstakes Period: Entries will be accepted online starting on or about February 11, 2016 and ending May 11, 2016. All online entries must be received by May 11,2016 11:59PM EST.

How to Enter:

1. Creating a Refer a Friend account on http://www.eluxurysupply.com/pages/refer-a-friend at any time during the period (defined below).
2. Agreeing to enter the Competition on the Competition entry page  between February 11, 2016 at 12:01 A.M. North American Eastern Time/6:01 A.M. Central European Time and May 11, 2016 at 11:59 P.M. North American Eastern Time/5:59 A.M. Central European Time.

Notification of Potential Prize winners: The Prize winners will be notified by telephone and/or e-mail within approximately seven (7) days of the closing of the Competition Period or upon the completion of the audit review, whichever is longer. If any audit-related questions have not been resolved within approximately seven (7) days of the closing of the Competition, Sponsors will advise entrants of the delay and will fix a new date for the notification of the Prize winners. If any Prize winner does not acknowledge acceptance of a Prize within ten (10) days after being notified that he or she is a Prize winner, their Prize will be irrevocably forfeited, and another Prize winner will be chosen using the same procedure specified above. In the event of a dispute as to who is the proper recipient of any Prize, such Prize shall be delivered to the individual whose credit card was used to open the new account through which the business at issue has been conducted during the Competition Period, but only if that person otherwise meets the eligibility requirements for participation in this Competition and is still employed by the business in question. If there is a dispute between any members, partners, creators, owners or employees of or investors in a business that cannot be resolved to the satisfaction of the Sponsors, that business may be disqualified in the sole discretion of the Sponsors. If any other dispute cannot be resolved to the satisfaction of the Sponsors, the business that is the subject of the dispute will be deemed ineligible or disqualified (as applicable).

Prizes: There are four (4) “Category Prizes” available to be won  for a total of four (4) Prizes in this Competition. Each Prize consists solely of: first place: a trip voucher; (b) second place: one $250 Gift Card to eLuxury; (c) and Third place: one $100 gift card to eLuxury.

Prize winners, with the exception of death or personal injury caused by the negligence of Sponsors, agree that Sponsors are not liable for any damages, costs or injuries sustained in connection with accepting any Prize in this Competition.

Travel voucher:

1. Is not redeemable for cash and will not be replaced if lost or stolen.
2. Is subject tocomplete terms and conditions of issuing agent and all arrangements must be made through the designated agent.
3. Expires one year from date of issue.
4. Is non-refundable and non-transferable.

Winner may select a $2,500 cash alternative instead of travel voucher.

PRIZE CONDITIONS: All expenses related to the acceptance or use of the prize is the sole responsibility of prize winner. Any expenses exceeding voucher amount are the sole responsibility of the winner.

If a prize notification or prize is returned as undeliverable, or if winner is found to be ineligible or not in compliance with these Official Rules that winner will be disqualified, and the prize may be awarded to an alternate winner in a separate random drawing.

Non-cash prizes are not redeemable for cash. Prizes are non-assignable or transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No cash in lieu of prizes and no exchange or substitution of prizes, except at the sole discretion of the Sponsor.Any other incidental expenses on prize not specified herein are the winner’s sole responsibility.

Winners are responsible for all federal, state, local and income taxes associated with winning prize. Grand Prize winner will be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law. Except where prohibited by law, entry and acceptance of prize constitute permission to use winner's name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

Pre-paid cards are not redeemable for cash and will not be replaced if lost or stolen. Pre-paid card usage is subject to the issuing company’s complete terms and conditions, including expiration dates.

Rights Granted by you: By entering this content you understand that eLuxury, anyone acting on behalf of eLuxury, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

Terms: eLuxury reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, eLuxury may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by eLuxury. eLuxury reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions.

 eLuxury has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering.

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, eLuxury reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability: By entering you agree to release and hold harmless eLuxury and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF the United Sates AND Indiana, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Indiana having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
